PRODUCT DELIVERY INFORMATION

Who will deliver the ordered products?

• Ordered products are delivered nationwide via express courier (FAN Courier / Sameday (easybox locker) / DPD / C Solution) and internationally via DPD Courier.

Express courier delivery

• Products are delivered via express courier services within 24 – 48 hours of receiving and verifying the order on business days. Orders placed after 4 PM are postponed to the next day; similarly, for orders dispatched on Friday, delivery will be on Monday.

*For packages with a value exceeding 145 lei, delivery is FREE.

• The shipping cost by courier is 16.00 lei, anywhere in Romania.
• For cash on delivery or locker payment, an additional fee of 6.5 lei is charged.

*For packages with a value exceeding 145 lei, delivery by Express Courier and easybox locker is FREE.

Orders outside Romania

• International delivery is exclusively via DPD Courier. The classic international road courier service – DPD is available for the following destinations: Bulgaria, Hungary, Poland, Greece, Slovakia, Austria, Germany, Italy, Croatia, Denmark, Estonia, Luxembourg, Slovenia, Latvia, Lithuania, Belgium, Czech Republic, France, Netherlands, Spain, Finland, Portugal, Sweden. Payment for individuals outside the country will be made exclusively by credit cards accepted for payment by pellamar.com or bank transfer. After selecting the products you wish to purchase, fill in the delivery address and the shipping cost for the selected country will immediately appear. The delivery time may vary depending on the final destination and the pick-up location, between a minimum of 3 and a maximum of 10 working days.

When are orders processed?

• Orders received between Friday 4 PM and Monday 8 AM, as well as on public holidays, will be verified, processed, and sent on the first business day.

When are orders dispatched?

• Orders placed Monday to Friday until 1 PM will be dispatched on the same day.
• Orders placed Monday to Friday after 1 PM will be dispatched on the next business day.

How long does it take for an order to arrive?

• The delivery time may vary depending on your location:

24h – 48h for customers in urban areas, by express courier;

24h – 72h for customers in rural areas, by express courier;

• You will be notified by phone or SMS of the exact delivery time of the package.

What happens if I am not at the specified address when the order is delivered?

• If you are not found at the specified delivery address within the agreed time frame, the courier will contact you to arrange the details of a new delivery. If delivery is not completed even after the second attempt, the package will be returned, and we will cancel the order.

What happens if the delivery date has passed and I still haven't received my order?

• If you have not received your order, please report this by calling 0338 730 306 or emailing magazin@pellamar.com.

What should I know when paying cash on delivery?

• For cash on delivery, payment is made in lei, in full, to the agent making the delivery. The value of the products is as confirmed by phone at the time of the order. No other fees are charged.

I did not find the product documents in the package. What should I do?

• Properly packaged products will be shipped along with the tax invoice. You must notify us by email magazin@pellamar.com or by phone at 0338 730 306 of the absence of any of these documents within 48 hours of receiving the products; otherwise, all of them will be considered provided.

When and how do I receive the invoice?

• After the delivery of your order is completed, you will receive the proforma invoice at your email address, and the tax invoice will be received upon delivery of the products.

I received a damaged, unsealed package. What should I do?

• If you find that your package has arrived damaged or unsealed, please refuse it (stating the reason for refusal on the delivery slip) and contact us as soon as possible to resolve the issue at 0338 730 306.

All products sold by PELLE AMAR COSMETICS benefit from a warranty from the date of purchase. Products that show physical defects such as: impacts, cracks, chips, burnt or burst components/parts, etc., damaged, removed or modified warranty labels or seals, products used in inappropriate conditions (inadequate power supply voltages, subjection to large temperature and pressure variations, mechanical shocks, incorrect handling, use of products in humid, dusty, noxious conditions or under the action of chemical substances, etc.), incorrect settings and installations, ungrounded sockets, ingress of liquids, metals or other substances into the equipment, mechanical or plastic intervention on the products, connection or disconnection of certain components during equipment operation are not covered by the warranty.

PELL AMAR processes personal data received directly from you, as data subjects, or indirectly during the course of commercial/contractual relations and/or participation in events organized by PELL AMAR.

Personal data is collected either only with your agreement/consent, if knowingly provided, voluntarily, on your own initiative, or at the request of PELL AMAR, for example through one of the online forms used, namely the online contact form, online product order form, etc., by subscribing to newsletters (of course, only after you have opted to receive these newsletters by filling in the data in the account registration form on a PELL AMAR website, etc.).

Your use of this website and other PELL AMAR websites is subject to these provisions and PELL AMAR's general Terms and Conditions.

What personal data does PELL AMAR process?

The persons (data subjects) whose data may be processed by PELL AMAR, exclusively for the purposes mentioned below, are:

– Individual customers of PELL AMAR (current, former or potential), visitors, general public, their representatives/proxies, legal or conventional;

Consequences of refusing to provide personal data

You, as the data subject, are obliged to provide complete, updated and accurate data.

In order to offer you certain products specific to PELL AMAR's activity, the personal data necessary for the sale will be requested, and refusal to provide such data may make it impossible to provide PELL AMAR products.

When you purchase a product supplied by PELL AMAR, as well as when you participate in events organized by PELL AMAR, we will collect personal data related to these endeavors. At the same time, as a visitor to PELL AMAR premises, we will collect personal data (image, data processed through video surveillance systems, etc.) in order to fulfill legal obligations and carry out current activities (legitimate interest).

By reading these provisions, and/or signing any document by which personal data is provided to PELL AMAR, or by providing personal data for the purpose of purchasing PELL AMAR products or participating in/paying the fee for participation in events organized by PELL AMAR and/or at PELL AMAR premises, data subjects are informed and/or expressly give their consent (agree) to the processing of personal data in accordance with the legal provisions regarding the protection of individuals with regard to the processing of personal data and the free movement of such data (national legislation and EU law).

If data processing is no longer necessary for providing a service, for fulfilling an obligation, and is not justified by a legitimate interest of PELL AMAR, data subjects may refuse such processing or withdraw their previously given consent, the refusal being effective for the future. For example, data subjects may withdraw their consent for data processing for direct marketing purposes, at any time and without needing to state a reason. After resolving the request to withdraw consent, the data subject will no longer receive commercial information about events/products offered by PELL AMAR.

What are the purposes of collecting personal data?

– Conducting PELL AMAR's economic/contractual activity;

– Invoicing and collecting the value of products offered by PELL AMAR;

– Marketing, promotion, advertising, including the transmission of general or personalized commercial offers, development and improvement of services;

– Customer relationship management; commercial communication with customers/suppliers by any means of communication;

PELL AMAR will consider all information collected from you as confidential and will not share it with third parties (with the exception of organizers/co-organizers of events organized by PELL AMAR at its premises, as described below) without your express prior consent.

Who are the recipients of your personal data?

The recipients of the data may be the persons (data subjects) who provided the personal data, as follows:

– Individual customers of PELL AMAR (current, former or potential), visitors, general public, their representatives/proxies, legal or conventional (for the purpose of conducting commercial/contractual relations);

The confidentiality of personal data will be ensured by PELL AMAR and will not be provided to other third parties other than those mentioned in this document.

Processing of personal data for promotional purposes (marketing)

Personal data provided by data subjects (such as: name and surname, email address, fax number, mobile/landline phone number) may be processed by PELL AMAR in compliance with their rights, especially the right to information and opposition, for the following purposes: marketing (including direct marketing), conducting commercial communications for PELL AMAR products, including those developed together with a PELL AMAR partner, by any means of communication, including through electronic communication services. Personal data provided by data subjects may also be used for promotional purposes (marketing) and for the products or services of other PELL AMAR partners, in compliance with the rights of the data subjects.

If PELL AMAR intends to use your data for direct marketing purposes (after the data subjects have opted in for this), the data subjects will be informed in advance. Data subjects can exercise their right to prevent such processing by selecting the appropriate boxes in the forms/documents used for collecting personal data.

Regardless of the situation, if you wish for PELL AMAR to stop processing your personal data, you can expressly request us to cease any data processing. At the same time, if you no longer wish to receive newsletters or informational materials from PELL AMAR, you can unsubscribe using the "Unsubscribe" button.

In relation to PELL AMAR, you benefit, according to applicable legal provisions, from the following rights: the right to access, the right to rectification, the right to erasure of data, the right to restriction of processing, the right to data portability, the right to object and the automated individual decision-making process.

Duration of personal data processing

To achieve the aforementioned purpose, PELL AMAR will process personal data throughout the period of PELL AMAR's activities, until the data subject, or their legal representative, exercises the right to object/erase (unless PELL AMAR processes the data based on a legal obligation or a legitimate interest). After the completion of personal data processing operations for the purpose for which they were collected, if the data subject or their legal representative does not exercise the right to object/erase, according to law, these data will be archived by PELL AMAR for the period specified in PELL AMAR's internal procedures and/or will be destroyed.

What security measures are used to protect your data?

While PELL AMAR makes every effort to protect personal data, the security of data transmitted to PELL AMAR websites cannot be absolutely guaranteed. Any data transmission is at the risk of the data subjects. Once personal data is received, PELL AMAR uses strict security procedures and measures against unauthorized, illegal use, destruction, accidental loss, or disclosure of personal data.

Security of banking data

In the case of card payments, sales are carried out through online payment solutions offered by authorized third parties in relation to PELL AMAR. In order to eliminate the risk of personal data falling into the possession and being used abusively/illegally by unauthorized persons, the authorized third parties in relation to PELL AMAR guarantee the legality and security of personal data (card number, expiration date, etc.) and the IT systems used.

Conditions for personal data transfers outside the EU and European Economic Area

Data transfers outside the EU and the European Economic Area can only be made under the conditions provided by specific national and EU legislation regarding the protection of individuals with regard to the processing of personal data and their free movement.

What are your rights?

By reading this document, data subjects have been informed about the rights they benefit from, according to applicable legal provisions, namely: the right to access, the right to rectification, the right to erasure of data, the right to restriction of processing, the right to data portability, the right to object and the automated individual decision-making process. At the same time, when processing is based on consent, data subjects have the right to withdraw their consent at any time in writing, addressed to PELL AMAR, under the conditions of applicable law, without affecting the legality of processing carried out based on consent before its withdrawal.

Also, data subjects have the right to object at any time, free of charge and without any justification, to the processing of personal data for direct marketing purposes, using, if applicable, the unsubscribe function included in marketing materials.

For other purposes, data subjects have the right to object, at any time, free of charge, to the processing of personal data they provide to PELL AMAR, with mention of the data and the intended purpose, only for well-founded and legitimate reasons related to their particular situation, except in cases where PELL AMAR demonstrates that it has legitimate and compelling reasons that justify the processing and that override the interests, rights and freedoms of the data subject or that the purpose is to establish, exercise or defend a right in court. In case of unjustified opposition, PELL AMAR is entitled to continue processing the data in question.

By reading this document, data subjects have acknowledged and understood that the personal data provided to PELL AMAR constitute decisive elements for accessing the products offered by PELL AMAR and/or conducting commercial/contractual activity.

If data subjects, directly or through a representative, exercise their rights mentioned above, in an obviously unfounded, unjustified or excessive manner, especially due to their repetitive nature, PELL AMAR may:

– either charge a reasonable fee taking into account the administrative costs for providing information or communication or for taking the requested measures;

– or refuse to comply with the request.

Also, if data subjects, directly or through a representative, exercise their right to object in an obviously unfounded, unjustified or excessive manner, especially due to their repetitive nature, PELL AMAR is entitled to consider the Contract concluded with the PELL AMAR Client as legally terminated, without any other formality or intervention of judicial courts, except for prior notification.

A legible copy of the signatory's identity document must be attached to the request.

Also, data subjects are recognized the right to file a complaint with a supervisory authority and to appeal to a judicial remedy.

These provisions may be subject to occasional changes/updates. We recommend that you check these provisions each time you use PELL AMAR websites to stay informed about them. By accessing PELL AMAR websites or purchasing PELL AMAR products through the mentioned websites, after changes, the new provisions will be considered accepted.

PRODUCT RETURNS

If you have a problem with a product, please access the ORDERS section of your account. Products can be returned within a maximum of 30 days from the date of receipt of the package.

You have two options for compensation for the return:

1. Replacing the returned product with another one.
2. Receiving the value of the returned product (its value at the time of purchase). The refunded amount will be the value of the products at the time of the order. If you paid for shipping, the shipping cost is non-refundable.

Returning products is free for any order, and the return process is very simple! You just need to fill out the return form or notify us of your intention to return by email at magazin@pellamar.com or by phone at 0338 730 306.

Please specify your chosen compensation method with your return request.

1. If you choose to replace the product with another product and the value of the latter is different from that of the returned product, we will proceed as follows:
   – if the product you choose is cheaper, we will refund the difference to your bank account.
   – if the chosen product is more expensive, you will pay the difference as with any other order, cash on delivery, upon receipt of the package, or in advance, by bank transfer.
2. If you opt for a refund, please send us the following information by email, to the same address: the 24-character IBAN code, as well as the full name of the cardholder.
   Refunds are made exclusively through a bank account; packages sent to us with cash on delivery will not be accepted. The refund will be processed within 5 working days from the confirmation of receipt of the return and all necessary information for payment (correct IBAN and account holder). For orders paid by card, the amount will be returned to the same card used for the transaction.

Return costs:

The transportation for returning products must be done through the same courier company through which you initially received the package, and the cost will be fully covered by us. After you notify us of your intention to return, we will initiate a pickup request.
If you wish to make the return under other conditions, you must pay the return cost.

Conditions for returning products:

Products must be returned in their original or equivalent packaging. Please use a protective box to prevent damage during transit.

PELL AMAR COSMETICS SRL reserves the right to refuse returns that do not comply with this return policy. The only exceptions are cases where products have manufacturing defects.

FAN Courier, Same Day Courier, DPD Curier, Poșta Panduri, SameDay locker network, and Poșta Panduri lockers are the express courier services through which your orders are delivered and which will receive personal data related to order delivery: name, phone number, and address. The same information will be provided to Poșta Română if you opt for shipping through Poșta Română services or to DHL for international order shipping.

To collect information about traffic on our website, we use Google Analytics. Google Analytics processes only anonymous data. The information collected by Google Analytics is in accordance with current legislation.
